Terms and Conditions PayToday Mobile Users

1. Introduction

PayToday is a mobile payment application that allows users to send and receive money, make payments, and manage their finances. This document outlines the terms and conditions governing your use of the PayToday application (“Application”) and its related services. By downloading, installing, or using the Application, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. Definitions
  1. “User” refers to any individual who downloads or uses the application.
  2. “Application” refers to PayToday Mobile application.
  3. “Services” refers to all services provided by PayToday including payment
    processing and transaction management.
3. User Responsibilities

To access the features of the PayToday Application, a user may be required to create an account. A user agrees to:

  1. Provide accurate and complete information when creating or updating your PayToday account.
  2. Maintain the confidentiality of your account credentials and all activities that occur under your account.
  3. Not engage in any fraudulent, malicious, or illegal activities using the Application.
  4. Not attempt to gain unauthorized access to any portion of the App or any other systems or networks connected to the App.
  5. Not impersonate any person or entity or misrepresent your affiliation with any person or entity.
  6. Authorize PayToday to debit your linked accounts or Wallets for any payments made through the Application at the time of a transaction.
4. Card Rules Compliance

PayToday complies with the EMVCo Card Rules regarding cardholder data and transactions. We use industry-standard security protocols and practices to protect your payment information. Specifically, we adhere to:

  1. Data Security: All cardholder data is transmitted securely using encryption protocols (e.g., TLS/SSL). We maintain physical and electronic safeguards to prevent unauthorized access to this data.
  2. Transaction Processing: PayToday processes transactions according to EMVCo standards, ensuring that cardholder data is handled with the highest level of care and security.
  3. Liability Shift: We acknowledge and adhere to the guidelines regarding liability shift according to EMVCo standards, ensuring clear risk mitigation for both PayToday and our users.
  4. Cardholder Notification: In cases of suspicious activity or fraud, we may notify cardholders as per EMVCo guidelines.
5. Payment Processing

Payments made through PayToday are processed in real time. Users acknowledge and accept that transaction completion is dependent on network availability and processor response. By using our services, you agree to adhere to EMVCo standards, which include:

  • Secure card authentication
  • Encryption of cardholder data
  • Compliance with PCI DSS (Payment Card Industry Data Security Standard)
6. Fees and Charges

PayToday may charge fees for certain transactions or services. By using our services, you agree to pay all applicable fees You agree to pay all applicable fees. Users are responsible for ensuring that they have sufficient funds in their accounts to cover any transactions made through the App.

7.Privacy Policy

8.Limitation of Liability
  • PayToday shall not be liable for any losses or damages arising from the use or
    inability to use the Application, including but not limited to any direct, indirect,
    incidental, consequential, or punitive damages. This limitation applies to the
    fullest extent permitted by law.
  • PayToday is not responsible for any unauthorized transactions made with lost
    or stolen cards. Users must report any such incidents immediately.
9.Intellectual Property

All content and materials available on the application, including but not limited to trademarks, logos, and text, are owned by or licensed to the Nedbank Namibia Limited and are protected by intellectual property laws.

10.Termination

PayToday may terminate or suspend users access to the application, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.

11. Disclaimer of Warranties

PayToday application and services are provided on an “as is” and “as available” basis. We make no warranties, whether express or implied, regarding the performance, reliability, or availability of the services.

12. Modifications to Terms

PayToday reserves the right to modify these terms and conditions at any time. Updated versions will be posted on the Application. Your continued use of the Application following any modifications constitutes your acceptance of the revised terms.

13. Governing Law

These terms and conditions and any disputes arising out of or related to the PayToday services shall be governed by and construed in accordance with the laws of The Republic of Namibia.
